GENERAL TERMS AND CONDITIONS OF SALE (GTCS)

ARTICLE 1: PURPOSE

These General Terms and Conditions of Sale (“GTCS”) describe the terms of remote sales of physical and digital goods between the Sole Proprietorship Patrick Malmartel (trade name: Tales on Tiles) and the Clients, and define the obligations and rights of the Parties.

These GTCS apply to:

  • Orders of physical and/or digital products in stock placed on the website www.tales-on-tiles.com

  • Pre-orders of physical and/or digital products placed on the website www.tales-on-tiles.com pending reprinting and availability.

ARTICLE 2: CHARACTERISTICS OF THE PRODUCTS OFFERED FOR SALE

2.1 Product descriptions

Products offered for sale on the website www.tales-on-tiles.com include descriptions enabling the Client to understand their main characteristics, including specifications, illustrations, dimensions, capacity, and price.

Tales on Tiles offers physical and digital Products subject to the specific terms outlined in these GTCS.

The Client must review these terms before placing any order.

The Client alone is responsible for selecting and purchasing a Product.

Photos and graphics presented by Tales on Tiles are non-contractual and do not engage its liability.

The Client must refer to each Product description to understand its essential features, availability, delivery timelines, and, where applicable, the minimum duration of the contract for ongoing or periodic supply.

Contractual information is provided in French and English and is confirmed at the latest when the Client validates the order.

2.2 Geographic availability

Products are offered for sale within the European Union, Monaco, Andorra, as well as Switzerland, Norway, Iceland, and the United Kingdom.

For orders shipped outside mainland France, the Client is considered the importer.

For all products shipped outside the EU and French overseas territories, prices will automatically be calculated excluding VAT.

Custom duties or other local import or state taxes may apply and are the sole responsibility of the Client.

United Kingdom: For products shipped to the UK, UK VAT and customs duties are included in the order and invoice. Tales on Tiles handles delivery under DDP (Delivered Duty Paid).

ARTICLE 3: VALIDITY OF PRODUCT OFFERS

Product offers apply while stocks last, as specified at the time of ordering.

ARTICLE 4: ORDERS

4.1 Account creation

Each Client must create an account containing the information required for delivery and invoicing. The account stores order history and invoices.

The account also stores purchased digital products in a PDF library, available for download as long as the account remains active.

Clients may order:

  • Physical products in stock

  • Physical products available for pre-order

  • Digital products

4.2 Order process

Clients must follow these steps:

  1. Select Product(s) and quantities

  2. Validate cart

  3. Register and/or log into the client account

  4. Select delivery method and provide delivery details

  5. Accept the GTCS

  6. Make payment

Clients may verify and correct their order details before validating payment. Product prices are displayed including French VAT. VAT is adjusted based on the delivery address.

Once validated and paid, the order cannot be cancelled.

A confirmation email is sent to the Client.

For digital products, the email includes a download link; files remain downloadable from the client's PDF library for a guaranteed period of 5 years.

If download issues arise, the Client may contact Tales on Tiles via the website contact form.

4.3 Order cancellation
4.3.1 Physical products (non-professional clients)

Orders for physical products may only be cancelled during the legal withdrawal period or in cases of force majeure at least 30 days before the expected delivery.

For pre-orders, the withdrawal period starts upon receipt of the product.

If a digital file was delivered with a pre-order and already downloaded, €7 will be deducted from the refund per downloaded file.

In case of the Client's death before shipment, heirs may cancel the order.

4.3.2 Digital products (non-professional clients)

Digital orders are final once the confirmation email containing the download link has been received, provided the file has been downloaded.

If the file has not been downloaded, the Client may exercise the right of withdrawal.

ARTICLE 5: PRICE

Prices are indicated in euros, including VAT, excluding delivery fees for physical products.

Delivery costs are added at checkout.

Custom duties and local taxes (outside the EU, DOM-TOM, and UK) are the Client’s responsibility.

Invoices are available in the client account.

Communication costs related to accessing and using the digital download service are the Client’s responsibility.

ARTICLE 6: PAYMENT TERMS

Payment is due at checkout:

  • Bank card: Visa, Mastercard

  • Bank transfer: upon request

Card payments are secured, encrypted, and not stored.

Transfer fees are the Client’s responsibility.

Orders are validated only after full payment.

Pre-orders are charged immediately.

ARTICLE 7: DELIVERY

7.1 Delivery terms
7.1.1 Physical products

Products are delivered within the EU, Monaco, Andorra, Switzerland, Norway, Iceland, and the UK within the estimated timeframe shown on the product page.

Delivery means the transfer of physical possession or control of the product to the Client.

Deliveries within France are handled via Colissimo; international orders are forwarded to local partners.

If delivery exceeds 30 days beyond the estimated date (excluding force majeure), the Client may cancel the order.

Orders containing pre-order items are shipped only once all items are available.

7.1.2 Digital products

Digital products are delivered via a download link sent by email.

7.2 Damages

Returns are accepted for significant tears, major binding defects, or functional damage.

Minor wear (small scratches, slightly bent corners, etc.) is not eligible.

Returns must be requested via the contact form, and shipping costs are borne by the Client.

If accepted, Tales on Tiles will replace, refund, or credit the product.

ARTICLE 8: TRANSFER OF OWNERSHIP – TRANSFER OF RISK

Ownership transfers after full payment.

Risk transfers when the Client physically receives the product.

ARTICLE 9: RIGHT OF WITHDRAWAL

9.1 Physical products

Clients have 14 days after delivery to request withdrawal and must return the product in perfect condition.

Return shipping costs are borne by the Client.

Damaged products are not accepted.

Refund is issued within 14 days of receiving the returned product.

9.2 Digital products

Under Article L221-28(13) of the French Consumer Code, digital products are not eligible for withdrawal once downloaded.

ARTICLE 10: SELLER LIABILITY – WARRANTY

Products comply with French regulations and come with:

  • Legal conformity warranty

  • Warranty against hidden defects

Clients may request repair or replacement.

Warranty periods and conditions follow the French Consumer Code.

Claims must be submitted via the contact form.

The warranty excludes:

  • Misuse

  • Negligence

  • Normal wear

  • Non-compliance with local laws

  • Force majeure

ARTICLE 11: PERSONAL DATA PROTECTION

Data collected is necessary for order processing and handled according to French and EU regulations (GDPR).

Clients may exercise their rights (access, correction, opposition, portability, limitation) via the contact form.

ARTICLE 12: INTELLECTUAL PROPERTY

All website content is protected by intellectual property laws.

Digital files are for strictly personal use.

Any reproduction, redistribution, or DRM circumvention is prohibited.

ARTICLE 13: UNFORESEEABILITY (IMPRÉVISION)

In the event of unforeseeable circumstances, a Party may request contract renegotiation.

ARTICLE 14: FORCE MAJEURE

If an obligation cannot be fulfilled due to force majeure, responsibilities are suspended. If such an event lasts more than 30 days, the contract may be terminated.

ARTICLE 15: GOVERNING LAW – LANGUAGE

These GTCS are governed by French law.

In case of translation, only the French version is legally binding.

ARTICLE 16: PARTIAL INVALIDITY

If one clause is deemed invalid, the remaining provisions remain applicable.

ARTICLE 17: PRE-CONTRACTUAL INFORMATION

Ordering on the website implies full acceptance of these GTCS.

ARTICLE 18: DISPUTES

Tales on Tiles and the Client will attempt amicable resolution.

Consumers may use mediation mechanisms.

Professional clients agree that any dispute shall be brought exclusively before the Commercial Court of Clermont-Ferrand.
